Terms & Conditions – QPON Merchant Portal

Merchant Account

• To access the portal, you must register for a merchant account with accurate and complete information.

• You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.

• QPON reserves the right to suspend or terminate accounts if fraudulent, misleading, or unlawful activity is detected.

Use of the Merchant Portal

• You may only use the portal to create, manage, and track promotions for your business.

• You agree not to misuse the portal, attempt unauthorised access, or interfere with its security and functionality.

• All promotions uploaded must comply with applicable laws, ethical standards, and QPON’s content guidelines.

Merchant Responsibilities

• You are responsible for the accuracy of all promotions, discounts, and business information you publish.

• You must honour all valid promotions listed on the app and ensure customers can redeem them as advertised.

• You agree not to list misleading or false promotions that could harm customers or QPON’s reputation.

Fees & Payments

• QPON operates on a pay-per-use model unless otherwise agreed. Fees for listing or promotions will be outlined during setup or in your merchant agreement.

• Payments are non-refundable except where required by law.

Intellectual Property

• All content, branding, design, and technology of the QPON portal remain the intellectual property of QPON.

• Merchants retain ownership of their own business logos, descriptions, and promotional content uploaded to the portal but grant QPON a license to display them on the platform and in related marketing.

Data & Privacy

• By using the portal, you agree to the collection and processing of data as outlined in our Privacy Policy and Cookie Policy.

• You must not misuse customer data obtained via the platform or use it for unauthorised marketing.

Limitation of Liability

• QPON provides the portal “as is” and does not guarantee uninterrupted or error-free operation.

• QPON is not liable for indirect, incidental, or consequential damages arising from your use of the portal.

• Our total liability to merchants will not exceed the total fees paid by you to QPON in the past 12 months.

Termination

• You may terminate your account at any time by contacting inquiries@qpon.lk.

• QPON may suspend or terminate your access if you breach these Terms, misuse the platform, or engage in unlawful activity.

Changes to These Terms

• QPON may update these Terms from time to time. Updates will be posted on this page, and material changes may be communicated directly to merchants.

• Continued use of the portal after changes take effect constitutes your acceptance of the new Terms.

Governing Law

• These Terms are governed by and construed in accordance with the laws of Sri Lanka. Any disputes will be subject to the exclusive jurisdiction of the courts of Sri Lanka.
